Agenda

1. The Government of India has constituted an Expert Committee under the Chairmanship of Justice B.N. Srikrishna, Former Judge, Supreme Court of India comprising of members from Government, Academia and Industry to study and identify key data protection issues and recommend methods for addressing them. The Committee has put out a White Paper on Data Protection Framework for India and has sought public comments. Submission of responses to the White Paper will be received till 31st January, 2018 preferably through the website: https://innovate.mygov.in/data-protection-in-india.

2. The Committee has also decided to conduct stakeholders’ consultation meetings at various cities as per below schedule. Organisation/People who are interested to participate in the below stakeholders’ consultation meeting are requested to kindly note the date, time and venue at the respective cities and are invited for the same. They are also requested to register for the meeting at https://innovate.mygov.in.

Programme

  • Welcome Address by Chairman, Committee of Experts on Data Protection
  • Consultation with civil society organizations, industry representatives, citizens and other stakeholders.
    • The primary object of the consultation is to provide stakeholders with an opportunity to present their views on issues which they wish to raise with the Committee directly. These could include issues that have not been specifically addressed in the White Paper, or any issue on which the stakeholder is uniquely placed to apprise the Committee of any relevant facts or material.
    • The Committee would especially appreciate inputs from stakeholders on the following issues:
      • How can notice and choice be incorporated in a data protection law to operationalize consent? How can children’s personal data be effectively protected?
      • How should “data localisation” and “cross border transfer of data” be dealt with under a data protection law?
      • What should be the nature and scope of the possible exemptions under a data protection law in the Indian context?
      • What are the different types of individual rights, their nature and scope which can be incorporated in a data protection law?
      • What are the different types of individual rights, their nature and scope which can be incorporated in a data protection law?
      • To what extent should data controllers be held accountable under a data protection legal regime?
      • What will be the impact of a data protection law on allied laws, particularly, the Information Technology Act, 2000, Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, and Right to Information Act, 2005?
    • Stakeholders are requested to make precise submissions on key issues that they wish to address. The Committee may consider prescribing time limits on submissions to ensure fairness and a chance for maximum participation.
    • The Committee recommends that participants register at [insert details of relevant link]. This would help the Committee in conducting the consultation process in an orderly manner.
    • In the interest of transparency, the consultation will be audio-recorded.
